1. MEMBERSHIP
1.1 Your membership will begin on the day you join.
1.2 You cannot cancel your membership during the initial period in force at the time you join.
1.3 After the initial period, your membership will continue unless you give 1 month’s written notice of cancellation to the General Manager.
1.4 Your membership is personal to you. You cannot transfer it to another person.
2. FEES
2.1 You may be asked to make an initial payment when you apply for membership.
2.2 Monthly instalments will be due on the same day of each calendar month. You may be asked to pay this fee, or part of it, for the month in which you join, on the day you join.
2.3 We may change the amount of your monthly subscriptions. If we do, we will write to you at the address you have given us and display details of the change on the Centre Notice Board one month before the change takes place.
2.4 You may choose to pay all your monthly membership fees in one annual lump sum on the day you join. If you choose to do this a refund will not be given if you cancel.
2.5 Monthly fees are payable even if you do not use the Centre.
3. FACILITIES
3.1 You are entitled to use the facilities available to your category of membership (as shown in the Centre Rules).
3.2 You may have to pay additional charges to use certain facilities at the centre. You can get a list of these charges from the Centre Reception. We can change these charges at any time.
3.3 We may change the Centre's opening times or withdraw any of the facilities at any time if we need them for tournaments, exhibitions or other activities, or in connection with any repair, alteration or maintenance work, or for any other reason. We will display notices of any minor changes on the Centre's Notice Board. If we need to make any significant change to opening hours or facilities we will give you reasonable notice by writing to you at the address you have given us and displaying details on the Centre’s Notice Board before any such change takes place.
4. OUR LIABILITY TO YOU
4.1 We shall compensate you, or your estate, in respect of:-
4.1.1 any uninsured loss or damage to your personal property, or
4.1.2 your death, or any personal injury suffered by you to the extent that the same is caused directly by:-
a) our negligence; or
b) our breach of this Agreement or any term implied by law, except where such breach is caused by you or an event outside our reasonable control.
4.2 Subject to clause 4.1 above all liability to you is excluded.
5. FREEZING MEMBERSHIP
5.1 In exceptional circumstances, you can ask us to freeze your membership. However, whether we agree will be our decision. You should apply, in writing, to the General Manager.
6. CANCELLING YOUR MEMBERSHIP
6.1 You may cancel your membership after the initial period, by giving one month’s written notice of cancellation, to the General Manager.
6.2 We can cancel your membership immediately if:-
6.2.1 you commit a serious or repeated breach of this Agreement or the Centre Rules and, if that breach is capable of being remedied, it is not remedied within 7 days.
6.2.2 in our reasonable opinion your behaviour is likely to endanger other members, their guests or staff, or adversely affect the Centre or our reputation.
6.2.3 any amounts you owe us remain unpaid 30 days after the due date; or
6.2.4 if you provide us with details you know to be false when applying for membership and those details reasonably affected our decision to grant you membership.
6. 3 If we cancel your membership we will not refund any monies paid.
6.4 We can prevent you entering the Centre if we have cancelled or agreed to suspend your membership.
6.5 If you cancel your membership we will not refund any membership fee paid in advance which relates to a period after cancellation.
7. INTRODUCTORY GUIDE
7.1 You must comply with the Introductory Guide, which form part of this agreement.
7.2 We may change the Introductory Guide at any time. We will post notice of any changes on the Centre Notice Board.
8. CHANGING THIS AGREEMENT
We can change this Agreement at any time. We will give you one month's notice of this change in writing at the address you have given us and by a notice on the Centre's Notice Board.
9. DEFINITIONS
'You': the member named above
'We' and 'us': Dearne Valley Leisure Trust
'Centre': Dearne Valley Leisure Centre
'Introductory Guide': the rules and regulations attached to this agreement
'Agreement': Your application form, these terms and conditions of membership and the Centre Rules
10. HEALTH
10.1 Before using any exercise equipment you must complete our questionnaire and supervised introduction session. We can refuse access to the Centre’s facilities if we consider your health may be adversely affected by the use of such facilities.
10.2 You must not take part in any physical activity for which you may not be fit. You are responsible for monitoring your own condition during any activity. If you have any concerns about your physical condition you must stop the activity and consult your doctor without delay.
11. MEMBERSHIP CARDS
11.1 We will give you a membership card, which you must use each time you enter the Centre or use the facilities. If another person uses your card, we can cancel your membership.
11.2 If you lose your membership card, we can charge you a fee to replace it.
12. CONDUCT
12.1 We can prevent anyone from entering the Centre if we think their conduct or appearance is inappropriate.
12.2 You must show consideration for the other people in the Centre.
13. YOUNG MEMBERS & YOUTH GYM
13.1 If you are under 18, your parent or guardian must sign this Agreement on your behalf. By signing this Agreement, your parent or guardian agrees to be responsible for your behaviour and actions at all times and to pay us any amounts due on your behalf.
14. LOCKERS
14.1 Lockers are available for hire on a daily basis.
14.2 We will remove any items left in lockers overnight and keep them for a period of four weeks, after which time we shall have no responsibility for them.
14.3 You must not leave personal property unattended at the Centre unless it is locked in one of the lockers provided.
